Terms of Service

By accessing or using the NextGen Digital Craft platform ("the Platform", "we", "us"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform. We may update these Terms from time to time. Continued use after an update constitutes acceptance.

You must be at least 16 years old to use NextGen Digital Craft. By creating an account, you confirm that you are at least 16 and that all information you provide is accurate and current. Enterprise accounts may impose additional eligibility requirements on their members.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at security@nextgendigitalcraft.com if you suspect unauthorised access. We reserve the right to suspend accounts that violate these Terms.

NextGen Digital Craft provides custom software development services and SaaS products. You may use our services and platforms for your own business operations and internal purposes. You may not: (a) share, resell, or sublicense access to NextGen Digital Craft SaaS products without written agreement; (b) scrape, reverse-engineer, or extract data from NextGen Digital Craft platforms; (c) use NextGen Digital Craft services to build competing software products; (d) upload content that infringes third-party rights or violates applicable law.

Custom software development services are governed by the Statement of Work (SOW) and Master Services Agreement (MSA) signed between NextGen Digital Craft and the client. These Terms of Service apply to NextGen Digital Craft's SaaS products and website. For all custom project engagements, the signed MSA and SOW take precedence over these general Terms.

Access to NextGen Digital Craft SaaS products (HRMS Portal, SFA App, AI Website Generator) is provided under a subscription agreement. Subscriptions are billed monthly or annually in advance. All prices are shown in INR unless otherwise indicated. Prices may change with 30 days' notice. Subscriptions are non-transferable and may not be shared between organisations without a separate enterprise agreement.

Custom software projects: Payments made against milestones are non-refundable once the milestone is delivered and accepted. SaaS product subscriptions: Eligible for a full refund within 14 days of the first payment if the product has not been actively used. After this window, no refunds are issued for subscription fees. Annual plans may be cancelled with a pro-rated refund at NextGen Digital Craft's discretion.

For custom software development projects, all intellectual property rights in the delivered software, including source code, design assets, documentation, and APIs, transfer to the client upon receipt of full payment, as specified in the signed MSA. NextGen Digital Craft retains ownership of its internal frameworks, libraries, and SaaS products. Client data and business information remain the property of the client at all times.

Your use of personal data is governed by our Privacy Policy, incorporated into these Terms by reference. By using NextGen Digital Craft, you consent to the data practices described in our Privacy Policy.

To the maximum extent permitted by law, NextGen Digital Craft's total liability to you for any claims arising from your use of the Platform shall not exceed the amount you paid to NextGen Digital Craft in the 12 months preceding the claim. NextGen Digital Craft is not liable for indirect, incidental, consequential, or punitive damages, including lost profits or lost job opportunities.

You may close your account at any time from your account settings. NextGen Digital Craft may suspend or terminate your account for violation of these Terms, non-payment, or as required by law. Upon termination, your right to use the Platform ceases. Data deletion follows the schedule described in our Privacy Policy.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India. If you are located in the EU or UK, you may also have rights under applicable consumer protection legislation.
